These terms and conditions (the "Terms and Conditions") govern the use of WWW.GETLANDTODAY.COM (the "Site"). This Site is owned and operated by My Desert Realty Inc. The Terms and Conditions apply to the use of this Site and do not extend to any linked third-party sites.

By using this Site, you indicate that you have read and understood these Terms and Conditions and agree to abide by them at all times.

Age Restrictions

The minimum age to use our Site is 18 years old. By using this Site, users agree that they are over 18 years old. We do not assume any legal responsibility for false statements about age.

Acceptable Use

As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

Cautions for Global Use and Export and Import Compliance

Due to the global nature of the internet, through the use of our network, you hereby agree to comply with all local rules relating to online conduct and that which is considered acceptable Content. Uploading, posting, and transferring software, technology, and other technical data may be subject to the export and import laws of the United States and possibly other countries. Through our network, you thus agree to comply with all applicable export and import laws, statutes and regulations, including, but not limited to, the Export Administration Regulations (http://www.access.gpo.gov/bis/ear/ear_data.html), as well as the sanctions control program of the United States(http://www.treasury.gov/resourcecenter/sanctions/Programs/Pages/Programs.aspx). Furthermore, you state and pledge that you:

1. Are not on the list of prohibited individuals which may be identified on any government export exclusion report (http://www.bis.doc.gov/complianceandenforcement/liststocheck.htm) nor a member of any other government which may be part of an export-prohibited country identified in applicable export and import laws and regulations.
2. Agree not to transfer any software, technology, or other technical data through our Site to any export-prohibited country.
3. Agree not to use our Site for any military, nuclear, missile, chemical, or biological weaponry end uses that would be a violation of the U.S. export laws; and
4. Agree not to post, transfer or upload any software, technology, or any other technical data which would violate the U.S. or other applicable export and import laws.

Changes

These Terms and Conditions may be amended from time to time to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

Commercial Reuse of Services

The user herein agrees not to replicate, duplicate, copy, trade, sell, resell or exploit any part, use, or access to My Desert Realty Inc. sites.

Conditions

These Terms and Conditions govern the sale of the available vacant lots on our Site. These Terms and Conditions apply to all the vacant lots displayed on our Site when you access it. This includes all products listed as being out of stock. All information, descriptions, or images we provide about our vacant lots are as accurate as possible. Buyer(s) acknowledges the land is being purchased "As-Is," subject to whatever physical condition and location the parcel may be at the time of sale: subject to all existing covenants, conditions, restrictions, reservations, exploration rights, easements, rights of way, assessments, zoning of record and any land use restrictions. All parcels sold by Seller are sold as vacant Property; Seller does not guarantee the Property's usefulness for any specific purpose and does not guarantee zoning. Seller may reserve mineral rights, if any, at Seller's sole discretion, any time before and including the recording of the deed to Buyer. Improvement bonds on the Property are to be assumed by Buyer(s) in addition to the sale price. Buyer(s) acknowledges having inspected Property and investigated its usefulness before purchasing, including the availability of access and utilities or lack thereof, and hereby accepts the property 'AS-IS.'

We reserve the right to modify, reject or cancel your order whenever necessary. If we cancel your order and have already processed your Payment, we will give you a refund equal to the amount you paid in accordance as long that is under the Cancelation Policy time frame. You agree that you are responsible for monitoring your payment instrument to verify receipt of any refund. Indemnity

Except where prohibited by law, by using this Site, you indemnify and hold harmless My Desert Realty Inc. and: our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses, including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Links to Other Websites

Our Site contains links to third-party websites or services we do not own or control. You are responsible for reading the terms and conditions and privacy policies of these third-party websites before using these sites. We are not responsible for the Content, policies, or practices of any third-party website or service linked to our Site. 

Limitation of Liability

My Desert Realty Inc. and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses, including legal fees from your site use.

Modifications

My Desert Realty Inc. shall reserve the right at any time it may deem fit, to modify, alter and or discontinue, whether temporarily or permanently, our service, or any part thereof, with or without prior notice. In addition, we shall not be held liable to you or any third party for any such alteration, modification, suspension, and discontinuance of our Services or any part thereof.

Payments

We accept the following payment methods on our Site:

• Credit Card, and
• Debit.

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument. Please refer to your Agreement for the Purchase and Sale of Real Estate Contract for additional information regarding your financing payments.  

If we believe your Payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Property Taxes

Buyer(s) shall pay all property taxes assessed on the Property during the term of the agreement. Within ten (10) days from the date of the Seller's statement, the Buyer(s) shall pay directly to the Seller the full amount of property taxes indicated in the statement. Seller shall send Buyer(s) a notice of Payment and a copy of all property tax billings by request only. 

Trademark Information

You herein acknowledge, understand, and agree that all of the Site and My Desert Realty Inc. trademarks, copyright, trade name, service marks, and other logos and any brand features, and product and service names are trademarks and as such, are and shall remain the property of My Desert Realty Inc.  You herein agree not to display and use in any manner the My Desert Realty Inc. and Site, logo or marks without obtaining My Desert Realty Inc. a prior written consent.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws. Those provisions will be deemed void and removed from these Terms and Conditions. The removal will not affect other provisions, and the rest of these Terms and Conditions will still be considered valid.

Subscriptions

Your subscription does need to renew. 

 Applicable Law

These Terms and Conditions are governed by the laws of the State of California.

Intellectual Property Infringement Claims Notice and Procedures

My Desert Realty Inc. will always respect the intellectual property of others, and we ask that all of our users do the same. With regards to appropriate circumstances and at its sole discretion, My Desert Realty Inc. may disable and terminate the accounts of any user who violates our Terms and Conditions and infringes the rights of others. If you feel that your work has been duplicated in such a way that would constitute copyright infringement, or if you believe your intellectual property rights have been otherwise violated, you should provide to us the following information:

1. The electronic or the physical signature of the individual that is authorized on behalf of the owner of the copyright or other intellectual property interest;
2. A description of the copyrighted work or other intellectual property that you believe has been infringed upon;
3. A description of the location of the site which you allege has been infringing upon your work;
4. Your physical address, telephone number, and email address;
5. A statement, in which you state that the alleged and disputed use of your work is not authorized by the copyright owner, its agents or the law;
6. And finally, a statement, made under penalty of perjury, that the aforementioned information in your notice is truthful and accurate, and that you are the copyright or intellectual property owner, representative or agent authorized to act on the copyright or intellectual property owner's behalf.
